Atmosphaera Audio End-User License Agreement (EULA)

This End-User License Agreement (“Agreement”) is a legal agreement between you (“Licensee”) and Atmosphaera Audio (“Licensor”) for the use of sound libraries and related materials (the “Product”). By purchasing, downloading, or using the Product, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not purchase, download, or use the Product.

1. License Grant

Atmosphaera Audio grants you a non-exclusive, non-transferable, worldwide license to use the Product in accordance with the terms of this Agreement. The Product is licensed, not sold, and all rights not expressly granted herein are reserved by Atmosphaera Audio.

2. Permitted Uses

You may use the Product in the following ways:

1. Incorporate the Product into your original music compositions, soundtracks, or other audio/visual projects.

2. Distribute your projects that include the Product as part of a greater work, provided the Product is not isolated or extractable.

3. Prohibited Uses

You may NOT:

1. Resell, sublicense, share, lease, or redistribute the Product in its original or modified form as standalone content.

2. Use the Product to create competing products, including but not limited to other sample libraries, sound packs, or loops.

3. Distribute or make the Product available in any manner that allows others to extract the Product as standalone files.

4. Claim ownership of the Product, in whole or in part.

4. Intellectual Property Rights

The Product, including all sounds, recordings, and associated materials, is the intellectual property of Atmosphaera Audio and is protected by copyright and other intellectual property laws. You are granted a license to use the Product, but you do not own the Product.

5. Termination

This Agreement is effective until terminated. Atmosphaera Audio may terminate this Agreement if you breach any of its terms. Upon termination, you must cease all use of the Product and delete all copies of the Product in your possession.

6. Limitation of Liability

To the maximum extent permitted by law, Atmosphaera Audio shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of the use or inability to use the Product. Atmosphaera Audio’s total liability shall not exceed the purchase price of the Product.

7. Warranties

The Product is provided “as is” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of laws principles.

9. Updates and Modifications

Atmosphaera Audio reserves the right to update or modify this Agreement at any time. Continued use of the Product after such changes will constitute your acceptance of the new terms.

By purchasing, downloading, or using the Product, you acknowledge that you have read this Agreement, understand it, and agree to be bound by its terms.
